General Conditions of Sale – Marian Flow On

ARTICLE 1 – PRESENTATION
These General Conditions of Sale (GCS) define the rights and obligations of Marian Flow On , a micro-enterprise registered under SIRET number 79512121900039, and of any Customer making a purchase on the site www.marianflowon.com .
They apply to any order placed on the site or through any other sales channel managed by Marian Flow On.
By validating his order, the Customer acknowledges having read and accepted without reservation these General Terms and Conditions.
ARTICLE 2 – DESCRIPTION OF PRODUCTS
Marian Flow On offers the creation and sending of personalized letters called “Flows” , accompanied by small attentions .
Each Flow is custom -designed based on the responses provided by the Customer via a personalization questionnaire. The customer receives the link for their questionnaire following purchase.
The photographs on the site are illustrative: the colors, textures or accessories may vary slightly depending on supplies, without altering the quality or spirit of the product.
ARTICLE 3 – ORDERS
Orders are placed exclusively via the website www.marianflowon.com or any order partner link.
Validation of payment constitutes firm and definitive acceptance .
The Customer is responsible for the information transmitted (address, content of the message, recipient, etc.).
Once writing or production has begun, no changes or cancellations can be made.
ARTICLE 4 – PRICE AND PAYMENT
Prices are expressed in euros and include all taxes (TTC) .
Delivery costs are calculated at the time of ordering, according to the weight and the chosen shipping method (La Poste, Lettre Suivie, Recommandé, Chronopost, etc.).
Payment is made via integrated secure payment solutions.
Full payment is made at the time of ordering.
ARTICLE 5 – DEADLINES AND DELIVERY
Each Flow is written and prepared within 72 hours maximum after receipt of the complete questionnaire.
Shipping is then carried out by La Poste or Chronopost , depending on the option chosen.
Marian Flow cannot be held responsible for delays or errors attributable to the carrier, an incomplete or incorrect address,
or an unclaimed package.
In the event of proven loss (confirmed by the carrier), Marian Flow On will offer a free return or the issue of a credit note of an equivalent value, valid for six months on the online store from its date of issue.
Marian Flow On creates and sends personalized letters aimed at providing a unique emotional experience.
The reception, reaction or lack of response from the recipient cannot in any case engage the responsibility of Marian Flow On, these being a matter of the personal freedom and sensitivity of each person.
ARTICLE 6 – PERSONALIZED PRODUCTS AND RIGHT OF WITHDRAWAL
In accordance with article L221-28 of the Consumer Code , the right of withdrawal does not apply to products made according to the consumer's specifications or clearly personalized.
As each Flow is a custom creation, no exchange or refund can be made after validation of the order.
For non-personalized products (small gifts, accessories, etc.), the Customer has 14 days from receipt to exercise their right of withdrawal by contacting:

Products must be returned in their original condition. Return shipping costs are the responsibility of the Customer.
ARTICLE 7 – MYSTERY SHIPMENTS AND CONFIDENTIALITY
In the case of a mystery or anonymous shipment , the name of the sender is not mentioned.
The recipient receives a letter signed Marian Flow On without knowing the author.
If he wishes, he can uncover the mystery by contacting Marian Flow On or by scanning the QR code in his letter, which will reveal the identity and message left by the customer.
The personal information of the Client and the recipient is strictly confidential and used only for the creation and dispatch of the Flow.
ARTICLE 8 – LIABILITY AND PARTNER PRODUCTS
Marian Flow On shall not be liable for any delay, loss or damage due to force majeure, incorrect address or carrier failure.
Marian Flow On's liability is limited to the amount of the order .
The small gifts on the site may come from collaborations with carefully selected designers, artisans or partner brands .
Their manufacture, composition and quality are the responsibility of their respective designers.
Thus, Marian Flow On cannot be held responsible for a manufacturing defect, non-conformity or damage resulting from the use of a partner product.
In the event of a problem, the Client can contact contact@marianflowon.com so that an amicable solution can be proposed (replacement, refund or direct contact with the creator concerned).
ARTICLE 9 – INTELLECTUAL PROPERTY
All texts, visuals, concepts and creations on the site www.marianflowon.com are the exclusive property of Marian Flow On .
Any reproduction, even partial, without written authorization is strictly prohibited.
ARTICLE 10 – PERSONAL DATA
The data collected is necessary for processing orders and creating Flows.
They are not resold to third parties under any circumstances.
In accordance with the GDPR and the “Informatique et Libertés” law, the Client may exercise his right to access, rectify or delete his data by writing to:

ARTICLE 11 – DISPUTES AND MEDIATION
These T&Cs are governed by French law .
In the event of a dispute, an amicable solution will be sought as a priority.
In the absence of an agreement, the French courts will have sole jurisdiction.
